A registration with the U.S. Patent and Trademark Office has numerous benefits, including conveying presumptive nationwide use and putting others on notice of your right in your trademark. However, in order to maintain rights in your trademark, it's important to continuously monitor your mark against infringers. An essential part of trademark protection is monitoring your marks to make sure new users are not using similar marks for similar goods or services that might confuse the public as to the source of the products or services.
We use proprietary software that informs the firm every time the U.S. Patent and Trademark Office rejects a new mark because of a potential conflict with your registrations. We then review these reports and contact you to see if you would like to take action appropriate for the circumstances, which may include filing a Letter of Protest with the U.S. PTO; sending a cease and desist letter; filing an opposition with the Trademark Trial and Appeal Board, or escalating the matter to Federal court.
As an add-on, we can also monitor your mark against "common law," or unregistered, users who may begin using a similar mark on social media, with a product or company name, or in some other way that might confuse consumers. We can also alert you when new applications are filed with the USPTO for marks that may be "confusingly similar" to your registration. Pricing for monitoring services varies widely depending on the scope of monitoring selected.
